1. Introduction

  1. In this Notice we explain how we will handle your personal data.

By using the privacy controls, you can specify whether you would like to receive direct marketing communications and limit some other uses of your information depending on the controls we have implemented from time to time.

2. How we use your personal data

In relation to the use of our products and services, we generate anonymised, unique ID references for each App account to allow us to provide our service to you, and use non-identifying information regarding your usage of the App or Site including tap/click-based behaviour and your device and software models and versions, to ensure we provide you with the correct versions of features for your hardware and software. We collect parent email addresses in order to provide our service, send necessary messages to you and to show you targeted adverts in your browser. We also collect your child's month and year of birth, a name or pseudonym and their language ability, under the same grounds. Finally, we ask your permission to enable video and voice features that collect video and voice data when your child is using our video or voice tools. Permission is requested for this use within the app at the point of registration, and all data collection is visible and clear in the interface. In each case the legal basis for this processing is our legitimate interests and provision of contract. The core innovation of our technology is language learning, and the delivery of our technology relies on our ability to monitor and improve our service and performance. Usage data is typically aggregated in such a way that it contains no information pertaining to an individual at all. In such cases, it will not be personal data and will no longer be governed by this Privacy Notice at all. In the case of identifiable voice data, we gather explicit consent from you as the Parent to collect and handle such data, and remove all other identifiers from such data before processing through third parties.
  8. We may process your account data ("account data") being the information provided to us when you register an account via the Site or App. This may include parent name, email address, and password. We only obtain account data from you directly, and it may be processed for the purposes of operating our Site and App, providing our products and services, ensuring the security of our Site, App and services, maintaining back-ups of our databases and communicating with you. The legal basis for this processing is;
  9. in connection with the account data necessary for us to provide our products or services to you, the performance of a contract between you and us and/or taking steps, at your request, to enter into such a contract; and
  10. otherwise, your consent to such processing.

We may process your personal data that are provided in the course of the use of our services ("service data"), whether by you or by any third party with whom you and we have a separate contractual relationship. The source of the service data is you or the relevant third party. The service data may be processed for the providing our services, ensuring the security of the Site, App and our services, maintaining back-ups of our databases and communicating with you. The legal basis for this processing is either the performance of a contract between you and us and/or taking steps, at your request, to enter into such a contract, or, where we have no contract with you, your consent to such processing in relation to any contract you may have in place with the relevant third party.
  12. We may process information contained in any enquiry you submit to us regarding products and/or services ("enquiry data"). This may be processed for the purposes of offering, marketing and selling relevant products and/or services to you. The legal basis for this processing is your the performance of our contract with you as a user of our services.
  13. We may process information relating to transactions, including purchases of goods and services, that you enter into with us through our Site, App or otherwise ("transaction data"). This may include your contact details and the transaction details, although we do not have any access to your card details, and these will only be available to our payment processing service provider. The transaction data may be processed for the purpose of supplying the purchased goods and services and keeping proper records of those transactions. The legal basis for this processing is the performance of a contract between you and us and/or taking steps, at your request, to enter into such a contract.
  14. We may process information contained in or relating to any communication that you send to us ("correspondence data"). This may include the communication content and metadata associated with the communication. The correspondence data may be processed for the purposes of communicating with you and record-keeping. The legal basis for this processing is our legitimate interests, namely the proper administration of the Site or App, our business and our communications with users.
  15. We may process any of your personal data identified in the other provisions of this Privacy Statement where necessary in connection with legal claims. The legal basis for this processing is our legitimate interests, namely the protection and assertion of our legal rights, your legal rights and the legal rights of others.
  16. In addition to the specific purposes for which we may process your personal data set out in this Section 2, we may also process any of your personal data where such processing is necessary for compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another natural person.
  17. Please do not supply any other person's personal data to us, unless we prompt you to do so.
  18. One of the functions of our application is a recording feature to aid inlanguage learning, whereby a child can speak a short phrase into the microphone of the device they are using, and the application then returns the phrase. This may include video recordings if you choose to enable the video feature. You can enable or reject audio and video recording functionality within the app if you do not wish us to collect recordings. If you have enabled this functionality, we will store these short recordings, but they are stored without your personal information or that of your child attached (“recordings”). We use recordings for the purposes of statistical analysis, to give us insight into how well our application is working and how well children are learning languages using our application. All recordings are stored in a secure server, without any personally identifiable information attached. To the extent that the recordings still constitute personal data under applicable law, our legal bases of processing is: i) in relation to our collection of data, your express consent (which can be withdrawn at any time by disabling the recording features, although that withdrawal will not affect the validity of our processing before consent was withdrawn); ii) the performance of our contract with you (in providing you with requested features); and iii) in relation to our processing for statistical analysis, our legitimate interests in improving our products and services. We do not share video data with any user or third-party, except for friends whom you have chosen to add to the platform with whom your stored recordings are shared.
  19. The ability to add 'Friends' is available in our service, to allow you to add friends to take full advantage of the 'social learning' aspect of Lingumi. All friends must be approved by you, and we take no responsibility for the content produced by friends you accept. You can report content as inappropriate directly inside the app. We recommend that you do not accept invitations from parents you do not know.
In short...

There are two categories of data we process and store about you. The first is the data you give to us directly, for example during registration you might give us your email address, name, and so on. We'll also ask for your child's first name, and month and year of birth. We do all of that in order to provide you with our service and products, which require this data to give you a custom experience. We also ask your permission in the app to collect voice and video data, to allow your child to use our learning tools.

The second type is (usually non-identifiable) data provided to us by third-parties, like your IP address or browser type, which we collect in order to give you a personal version of our products. For example, if you are in Germany, we'll show you our website and app in German.

There may also be legal grounds upon which we store and pass on your data to law enforcement, if necessary.

3. Providing your personal data to others

  1. We may provide your personal data to our third party service providers We do not pass any identifiable child data to any third parties except for voice recordings from which other identifiers are removed, and their sharing is explicitly permissioned in a separate opt-in notice within the interface. We do not collect any other personally identifiable information ourselves beyond first name and month and year of birth, in compliance with Children's Online Privacy Protection Act (COPPA) regulations. Such data is collected only from parents on our website, and, where collected in our app, on screens inaccessible to children, behind parental gates. 
    In particular, our service providers include:
    (ii) Our nominated payment processing service providers. We offer several payment gateways, so, depending on your choice of payment option, these providers may process certain information such as credit card information in taking payments from and making payments to you. They include PayPal Inc., Chargebee Inc., GoCardless Ltd., Billwerk GmbH and Heidelpay Payment GmbH, and Shopify, Inc., who help us to process orders and arrange for the despatch of Lingumi physical products, and who will process name and address details to do so if you choose to buy physical products from us;
    (iii) Billwerk GmbH, Stripe Inc., and Chargebee Inc., who provide subscription billing services to us, and who will process personal information in relation to our subscribers to do so;
    (iv) Our advertising provider, Appsflyer, whose services we use to advertise our services. Permission for such data use is specifically requested from each parent as they create their parent account. We will share your child's age and language ability together with your (as the parent) email address and country to provide targeted adverts to Lingumi users and others who might be interested in our services;
    (v) Our hosting service providers, Amazon Web Services, Inc., Heroku, Inc., and Webflow Inc., who may process certain information in hosting our platform, data and systems;
    (vi) Our authorisation provider, Auth0, Inc., whose services we use to allow you to register, log in, and log out of our Site and App.Site and App;
    (vii) Intercom, Inc. and Mixpanel, Inc., whose services we use to provide our service to you, such as, for example, sending a message to parents who have completed a certain lesson on a given day. Permission for such data use is specifically requested from each parent as they create their parent account. We use this data to personalise the experience to each user. We do not collect the full name or full date of birth of your child and do not pass personally identifiable child data to these data processors;
    (viii) Bugsnag, Inc., DataDog Inc., and Functional Software, Inc. ('Sentry') to whom we send usage and crash data to help us fix problems in the application; and
    (ix) Soapbox Labs Ltd., whose API we use to process and score voice recordings to show your child their pronunciation level and customise the learning experience over time.
  2. Each of these service providers may further provide your personal data to their own service providers who provide necessary support functions (for instance, the third parties who host their servers). However, such disclosure will again only be for the purpose of providing the relevant services to us.
  3. We may provide recordings (which are anonymised and which do not constitute personal data) to third parties for the purposes of research and analysis.
  4. We may also provide your personal data to any acquirer of our business or assets (in which case our accumulated data, including your personal data, will be comprised in our business or assets).
  5. We may disclose your personal data if required to do so by law, to prevent an unlawful act, or otherwise to appropriate authorities in connection with any civil action or criminal report or investigation relating to your activities.
  6. We may provide your personal data (excluding email addresses, but including video and audio recordings) to the friends you add to the Lingumi platform. No user on the platform can access another user's personal data without a bilateral request and confirmation of friendship. We recommend that you do not accept invitations from any user with whom you are not personally familiar.
  7. Otherwise, we will not provide your personal data to any third parties. If you have consented to us doing so, we may email you about our own activities and provide you with information regarding third party promotions by our commercial partners (e.g. "A publisher of children's books is offering a discount to Lingumi users"). However, we will not pass your details to those commercial partners for marketing purposes (so you should not get emails saying "We publish children's books and we hear you're a Lingumi user…").
  8. In addition to the above services, we may provide (non-personal) technical information regarding your use of the site and app to Google, Inc. for use in Google's Google Analytics service. This information includes usage statistics, crash information, device model, software versions, and app versions. We share the same non-personal information to analytics services including Branch, FullStory and Google, including their subsidiary, Firebase. We never share this information with third-parties for commercial use.
In short...

We don't sell your personal data, or give it to third-parties for commercial reasons. We do, however, store and process your data using third-parties who help us deliver our service. For example, payment providers who help process payments, hosting providers who host our Site and App, and analytics providers, who help us understand how families use our website and services.

International transfers of your personal data

  1. In this Section 4, we provide information about the circumstances in which your personal data may be transferred to countries outside the European Economic Area (EEA).
  2. The hosting facilities for our App is located within the EEA. The hosting for our Site and App is provided by Amazon Web Services, Inc. Our App is hosted on their servers in Ireland, and we may transfer all personal data to our hosting service providers in that country. Our Site is hosted by Webflow, Inc., and their partners Fastly Inc., and Amazon Cloudfront. To improve the speed of delivery of our website, versions of our Site are hosted on servers in multiple global locations. Personal data such as email address, first name and last name are stored by our authentication provider, Auth0, Inc., in the United States.
  3. Some of the third parties to whom we may transfer your personal data, discussed in Section 3, may be located outside the EEA or may transfer your personal data to their own service providers located outside the EEA. If so, then we will ensure that transfers will only be made to countries in respect of which the European Commission has made an "adequacy decision", or otherwise will only be made with appropriate safeguards, such as the use of standard data protection clauses adopted or approved by the European Commission. You may contact us to enquire about such safeguards so that you may obtain a copy of them or so that we may direct you to them.

We store your data in the European Economic Area (EEA). However, some of our third-party service providers may store your personal data in the United States or elsewhere outside the EEA. Each of these providers has their own data protection policies.

Retaining and deleting personal data

  1. This Section 5 sets out our data retention policies, which are designed to help ensure that we comply with our legal obligations in relation to the retention and deletion of personal data.
  2. Personal data that we process for any purpose or purposes shall not be kept for longer than is necessary for that purpose or those purposes.
  3. We will retain and delete your personal data as follows:
  4. all account and service data will be retained for as long as we provide products or services to you, or as long as you have an account with us. Twelve months after the end of such period it will be deleted from our systems;
  5. enquiry and correspondence data will be retained in accordance with our email archiving policies. Typically this will provide for data to be archived after twelve months, and deleted entirely after six years;
  6. recordings will be retained for two years;
  7. transaction data will be retained for six years; and
  8. usage data will be retained for between three and twelve months from collection, and then deleted. As an exception, usage data relating to App performance, or aggregated usage data from which no individual can be identified, may be retained by us indefinitely, as this provides us with important insights into user behavior and is a significant business asset.
  9. We may retain your personal data where such retention is necessary for compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another natural person.

Your rights

  1. In this Section 7, we have summarised the rights that you have under data protection law. Some of the rights are complex, and not all of the details have been included in our summaries. Processing Payments

  1. The first payment will be taken from you if you register for a Membership with Club Lingumi at the time that your Membership begins, or, if in a Trial Membership, at the expiry of your trial Membership.
  2. Where a Membership or Trial Membership is purchased on a platform other than our Site, payment information should be sought on said platform, of which Apple and Google’s app stores are the most prominent.
  3. The payment that you make when placing an order is a payment made through our nominated payment processing service providers, PayPal (Europe) S.a.r.l. et Cie, S.C.A. (“PayPal”), Billwerk GmbH (“Billwerk”), Stripe Inc., GoCardless Ltd., or Heidelpay Payment GmbH (“Heidelpay”). You can make payment by most major debit or credit cards, and in particular any Visa, or MasterCard card. We will not receive your credit or debit card information as this is processed by our payment processing service provider. Payments may also be made through Apple and Google’s App Store or Play Store platforms.
  4. You can read the Privacy and Cookie Policy on the Site for further information. We reserve the right to decline any transaction or our payment processing service provider to reverse any transaction (for example, to prevent money laundering or fraud). If your payment is not received by us for this reason or for any other reason then your order will not be accepted or, as applicable, your Membership will not renew.
  5. (Where using PayPal) The terms on which PayPal provides payment processing services, which govern your use of your PayPal account, how funds are relayed to you, any applicable processing fees and other important issues, are all set out in your contract with PayPal based on PayPal’s standard terms. We are not responsible for PayPal’s performance or for any dispute between you and PayPal.
  6. Although Membership options may be listed in UK pounds sterling or euros, you may pay in any currency. The conversion rate applied will be determined by our nominated payment processing service provider.
  7. Unless otherwise provided in the listing, all prices are inclusive of VAT. It will not necessarily be made clear to you at the time of taking payment whether you are paying VAT and, if so, how much, but we will endeavour to display this information where possible.
